1. Definitions

For the purposes of interpreting these Terms and Conditions for the Service, the following terms shall have the meanings attributed to them below:

  • User: Any individual or legal entity visiting the Website.
  • Candidate: A registered user as a job seeker on the Website.
  • Client: A registered user on the Website who requests and contracts services, whether a legal entity or a self-employed professional.
  • Terms and Conditions of Use: These conditions.
  • Services: The services offered and provided by The Wise Seeker on this Website.
  • My Account: A reserved access area for the client.

2. Preliminary Considerations

The Client declares that they are of legal age and have full capacity to contract and be bound by accepting these conditions. They must read the content carefully if they wish to access and use the information and services offered. If the Client does not agree with these provisions, they must refrain from using and accessing the Website and its contents, and also refrain from using the services we provide.

If you accept these conditions, contract, use, and access the Website on behalf of a company or legal entity, you represent that you have sufficient authority to bind the company to these conditions, contract, use, and access the Website, and you will be responsible for this acceptance.

These conditions prevail over any other document signed between the Client and The Wise Seeker, except in situations where it is expressly agreed in writing that other documents signed between the Client and The Wise Seeker prevail. If any of the Services offered have particular conditions, these will be duly informed to the Client and must be accepted before their provision.

These conditions are effective from the date of their last update, are public and easily accessible on the Website. The Wise Seeker reserves the right to unilaterally modify them at any time and without prior notice if deemed necessary, in which case they will come into effect from their publication and will apply to all Website clients, both current and future, from that date. Therefore, we recommend consulting these conditions regularly. Entering the Website or using The Wise Seeker's services after modifying these conditions implies knowledge and acceptance of the new modified conditions.

Such modifications, extensions, or service withdrawals will not affect services already contracted by clients, which will be governed by the conditions established and in force at the time of contracting them. If accepted by the Client, the new contracting conditions will fully replace the conditions in force until that moment, taking effect in the new service contracted from the date of acceptance of the mentioned new conditions.

These terms and conditions will only be fully accepted by the client at the time of requesting a service. If you are a regular client, we recommend visiting these conditions regularly to stay updated on the updates.

The unconditional acceptance of these conditions is indispensable for the provision of the Service by The Wise Seeker. The Client states, in this regard, having read, understood, and accepted these conditions, made available at all times, prior to contracting, on this Website.

Contracting services also entails the Client's acceptance of any notices, usage regulations, and instructions that may be communicated by The Wise Seeker after accepting these Conditions; non-acceptance within the granted period will result in the termination of the Contract by the Client.

The Wise Seeker's services are designed to meet professional needs, not for individuals acting outside their business or professional activity. The Client acknowledges, declares, and accepts this service as a professional. Consequently, Consumer and User Regulations will not apply.

IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS OR DO NOT HAVE SUFFICIENT AUTHORITY TO ACCEPT THEM, DO NOT CONTRACT, DOWNLOAD, INSTALL, COPY, USE, OR ACCESS THE SERVICE.


3. Identification Data

The Website is owned and managed by The Wise Seeker S.L., with NIF B88209929 and registered office at Calle Almagro nº1, 2ª izda., 28010 Madrid, with whom as a User you subscribe to these Terms and Conditions as a Provider of Information Society Services.


4. Purpose

These Terms and Conditions regulate the requirements for acquiring Client status and the associated rights and obligations, as well as the rules of access and use of the Website, with the primary purpose of enabling the Client's job offer publication service. If any of the Services offered have particular conditions, these will be duly informed to the Client and must be accepted before their provision.


5. Requirements for Registration

Individuals of legal age and with full capacity to contract who subscribe to these Terms and Conditions as a Client, individual entrepreneurs, or on behalf of and representing a legal entity, and who are active clients of The Wise Seeker on the date of their registration as a user, can request Client status. When the application is made on behalf of a legal entity, it will be understood that the person registering has the capacity to contract on its behalf, either because they have sufficient power for it or because they act by order or with the consent of the entity. The Applicant will be personally responsible for the reality of their capacity to contract on behalf of said legal entity in case of lack of truthfulness.

Registration as a Client implies reading and express acceptance without reservation of these Terms and Conditions, the Legal Notice, and the Privacy Policy of the Website (in the version published at the time of registration), which the Applicant declares to have known before accepting, and which may be stored and reproduced by them.


6. Client Registration and Service Contracting

To acquire Client status, it is necessary to register by entering an email as an identifier and a freely chosen password (hereinafter the Keys). A message will then be sent to the indicated email address to verify the email and validate the registration process. If the verification cycle is not completed through the message received in the email, the registration as a Client will not be processed.

Once the registration is processed through the "Client Registration" form, the generated Keys will enable access to a personalized space on the Website where the desired product can be contracted in four steps: Step 1: company details; Step 2: job details; Step 3: publication type; Step 4: payment.


6.1 Use of Keys

The registration Keys are personal and non-transferable for each client. The client agrees to use their Keys diligently, taking all reasonable measures to protect them, and The Wise Seeker assumes no responsibility if such Keys have been communicated to third parties. In case of loss, theft, or unauthorized use of the Keys, The Wise Seeker must be informed without undue delay so that appropriate measures can be taken.

The Client will be solely responsible for controlling their authorized users and passwords and for updating them when necessary.

The Wise Seeker presumes, unless informed otherwise about their loss, theft, or misuse, that access through the Keys is made by the Client to whom they belong.


7. Price

The price for the services will be the one offered on the Website at the time of contracting by the client. The prices displayed on the Website are final, in Euros (€), and include taxes at the prevailing rate on the date of tariff publication. Any officially generated tax rate variation will be communicated to the client, transferring the modification.

The price will only cover the services effectively contracted or selected by the client, so if such services are eventually expanded or modified, the price may vary.

The price of the services can be reviewed and vary at any time. This review will be communicated to the client and will be applicable, unless otherwise agreed by the parties.

The Client's payment obligations are non-cancelable, and fees paid for contracted services are non-refundable.

The amounts contracted by the Client cannot be reduced during the minimum term set for each service.


8. Payment Method

Currently, and during the contract duration with The Wise Seeker, the payment for Services will generally be made through the enabled payment platform, Stripe. If there is a change of platform, the corresponding platform must be respected for the existing contracts, unless otherwise agreed between clients and The Wise Seeker. To proceed with the payment, the client must enter their credit or debit card payment details or their Stripe account information on the payment platform. These payment-related data will not be stored by The Wise Seeker and will only be retained by the payment platform while the purchase is being made or the payment is being processed, or during the service usage period, to enable the refund of corresponding economic amounts.

Invoices with delayed payments will be subject to a monthly interest rate of two percent (2%) on the outstanding balance, plus all necessary collection management costs, with a minimum of €30 per management.

In the exceptional case where The Wise Seeker is responsible for collecting services and invoices, the Client is obligated to provide valid and updated information about their credit card, bank account, or any other document or information that may serve as a payment method and accepted by The Wise Seeker. The Client authorizes The Wise Seeker to charge the total amount of contracted services, as well as to charge for any expansion of services made by the Client and accepted by The Wise Seeker. Given the nature of the services, payment for the mentioned services will generally be made in advance, unless otherwise agreed.

If the Client considers that their invoice is incorrect, they have a period of 10 business days to contact The Wise Seeker to jointly review the invoice and, if applicable, receive a corrected invoice.

At no time during the service purchase process, except in exceptional cases of direct collection, will The Wise Seeker or any member of its organization know the payment data, which are directly digitized on the payment gateway (with security systems that prevent interception, modification, or falsification of information). No computer file of The Wise Seeker contains or will retain such data. Therefore, The Wise Seeker cannot be held responsible for any fraudulent or improper use of these payment data by third parties.

9. Client Obligations

All information provided by the Client must be truthful. To this effect, the Client guarantees the authenticity of all data communicated as a result of completing the forms included on the Website. Similarly, it will be the Client's responsibility to keep all information provided to The Wise Seeker permanently updated to reflect the Client's real situation at all times. In any case, the Client will be solely responsible for any false or inaccurate statements made and for any damages caused to The Wise Seeker or third parties due to the information provided.

The Client agrees to use the Website diligently, correctly, and lawfully, and to use it in accordance with the law, the Legal Notice, these Terms and Conditions, and other notices, usage regulations, and instructions that are communicated, as well as with generally accepted morals and good customs and public order.

To this end, the Client will refrain from using any of the Services for illegal, prohibited, harmful purposes or effects on the rights and interests of third parties, or that may in any way damage, disable, overburden, deteriorate, or prevent the normal use of the Website.

The Client guarantees the accuracy, completeness, and reliability of the data and information entered in their profile, as well as:


  • Guaranteeing that job offers will not include defamatory or denigrating proposals or offers, elements that infringe against The Wise Seeker or third parties, or denigrating, abusive, discriminatory, obscene, racist, or similar elements.
  • Not introducing any viruses, trojans, or spyware of any kind into or through the Website or published offers.
  • Accepting that job offers published on the Website will be visible to all Candidates, Users, and the general public at all times.
  • Not opposing The Wise Seeker's exercise of the rights and discretionary powers stated in these Terms and Conditions.
  • Exonerating and holding The Wise Seeker harmless against any third-party claims arising from the violation of fundamental rights, industrial or intellectual property rights, public order, or morality in any published offers on the Website. To this effect, the Client agrees to indemnify The Wise Seeker for any damages caused, without any limitation.

The Wise Seeker reserves the right to deny or withdraw access to the Website, at any time and without prior notice, to Clients who breach these Terms and Conditions.

The Client accepts and assumes that The Wise Seeker reserves the following rights and powers, which will be freely and discretionarily exercised, without prejudice to the guarantees and responsibilities assumed by the Client according to the previous paragraphs and without needing further authorization or consent from the Client:

  • To reasonably verify the identity data provided by the Client.
  • To review the text and content of the ads the Client wishes to publish on the Website before publication.
  • To reasonably modify or alter the text of the offers the Client wishes to publish.
  • Not to publish, as well as to immediately and/or at any time withdraw offers that, in The Wise Seeker's judgment, do not comply with the rules established in these Terms and Conditions.
  • Not to publish, as well as to immediately and/or at any time withdraw the following offers:
  • Those belonging to a Client who is a direct or indirect competitor of The Wise Seeker.
  • Those belonging to a Client, or those offers, whose inclusion on the Website could damage or harm The Wise Seeker's reputation or brand.
  • Those belonging to a Client who: i) is in default of fulfilling their obligations or commitments with The Wise Seeker; or ii) has an open claim against The Wise Seeker.
  • Those suspected of being related to any criminal, illegal, or punishable activity.
  • Those intended to advertise, offer, perform, or promote actions contrary to free competition, including those aimed at progressive customer acquisition (chain, snowball, or pyramid systems).


10. Responsibility

The Wise Seeker will not be responsible for the Client's relationships with third parties, even if such relationships are derived from accessing the Website. If any claims or legal actions occur between the Client and third parties, the Client releases The Wise Seeker and any of its employees, suppliers, and other collaborators from all responsibility, agreeing to hold them harmless regarding the same.

The Wise Seeker will be exempt from any liability arising from accessing and using the Website (performance failures, interruptions or delays in service operation, system or line failures, etc.), even if a failure or malfunction causes damage to third-party computer tools. In this regard, the Client accesses the Website at their own risk.

However, The Wise Seeker declares that it has diligently adopted the necessary measures, within its capabilities and the state of technology, to ensure the Website's operation and prevent the existence and transmission of viruses and other harmful components.

11. Privacy Policy

At The Wise Seeker, we take the personal data you provide us when using our services very seriously and are committed to keeping your personal data completely safe.

In accordance with the European Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016, the General Data Protection Regulation of the European Union, and the Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights, we inform you that your personal data will be processed according to the requirements established in the referred regulation.

12. Assignment of Rights

The rights and obligations of The Wise Seeker derived from the ownership of this Website and these Terms and Conditions may be assigned by The Wise Seeker to any third party, without the need for notice or consent of any kind from the Client.


13. Partial Nullity

If any stipulation of these Conditions is declared null or void, it will be considered unenforceable and will not affect the rest of the stipulations, which will be complemented and interpreted with each other to fill the normative gaps left by the stipulations that have been declared null.


14. Contract Archiving

Communications, contracting orders, and payments that intervene during transactions made on the Website may be archived and stored in The Wise Seeker's computerized records to constitute proof of the transactions, respecting reasonable security conditions and applicable laws and regulations, specifically addressing the Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights and the Law 34/2002 of 11 July on Information Society Services and Electronic Commerce.

15. Gender-Neutral Clause

In this text, the masculine gender has been used as a generic term to include both male and female users and clients, without implying ignorance of existing gender differences, to avoid overly complex writing.


16. Applicable Legislation and Competent Jurisdiction

These Conditions and the relationships between The Wise Seeker and the Client will be governed and interpreted according to Spanish legislation.

For any legal issues that may arise in the interpretation and execution of these conditions, the parties, expressly waiving their own jurisdiction if they have any, submit to the jurisdiction and competence of the Courts and Tribunals of Madrid (Spain).
